Jelly & Custard Media ("we", "us") is a content and social media agency based in Cape Town, South Africa. This policy explains what personal information we collect through this website, why we collect it, and what your rights are under the Protection of Personal Information Act (POPIA).

In short: we only ask for what we need to reply to your enquiry, we don't sell your information, and you can ask us to see or delete it at any time by emailing info@jellyandcustardmedia.com.

1. Who is responsible for your information

2. What we collect

When you book a discovery call using the form on this site, you give us:

your name, business name, email address and phone number;
whether we may contact you on WhatsApp;
what services you are interested in, your goals, your budget range and your timeline;
any notes you choose to add.

If you message us on WhatsApp, Instagram or TikTok, we receive whatever you send in that conversation.

Our hosting provider may automatically record technical information when you visit, such as your IP address, browser type and the pages requested. This is used to keep the site running and secure.

3. Why we use it

To reply to your enquiry, book your call and prepare a quote.
To deliver services if you become a client.
To keep the website secure and working properly.
To meet legal and accounting obligations.

We will not send you marketing messages unless you have asked for them or become a client and can opt out at any time.

4. Information saved in your browser

While you fill in the booking form, your answers are saved in your own browser (local storage) so you do not lose them if you leave the page. This stays on your device and is not sent to us until you press submit. It is cleared once the form is sent.

5. Cookies and tracking

By clicking “Accept all cookies” on our cookie banner, you agree to the storing of cookies on your device and the use of similar technologies to enhance site navigation, analyze site usage, personalize advertising, and assist in our marketing efforts.

Specifically, we use the Meta (Facebook) Pixel and the TikTok Pixel to measure how our adverts perform and to count booking requests. They set cookies and send your browsing activity on this site to Meta and TikTok, but only if you accept. If you decline, they do not load. You can change your mind at any time by clearing this site's data in your browser, and the banner will appear again.

6. Who we share it with

We do not sell your information. We only share it with service providers who help us run the site and our business, and only as needed:

Web hosting and email providers, who store and deliver the form submission to us.
Google Fonts, which loads the website's typefaces. Google may receive your IP address when it does.
WhatsApp (Meta), if you choose to contact us through the WhatsApp buttons. Their own privacy policy applies to that conversation.

We may also disclose information where the law requires it.

7. How long we keep it

Enquiries that do not lead to work are kept for up to 24 months and then deleted. Client records are kept for as long as we work together and for the period required by tax and company law afterwards.

8. How we protect it

We use reasonable technical and organisational measures to protect your information, including limiting access to the people who need it. No method of sending information over the internet is completely secure, but we take care to reduce the risk.

9. Your rights

Under POPIA you may:

ask what personal information we hold about you and request a copy;
ask us to correct or update it;
ask us to delete it, or object to how we use it;
withdraw your consent to anything you previously agreed to.

10. Links to other sites

This site links to Instagram, TikTok and WhatsApp. We are not responsible for the privacy practices of those platforms, so please read their policies.

11. Children

Our services are for businesses and adults. We do not knowingly collect personal information from children.

12. Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last changed.
